By accessing our website holabayahibe.com and paying for the Service, you agree to be bound by these Terms. If you do not agree with any part of the terms, you may choose not to book the service on this website. By making a reservation with HolaBayahibe, you ("Client" or "Passenger") agree to be legally bound by these Terms.
1. Eligibility and Authority
You must be at least 18 years old to make a reservation.
If booking on behalf of other passengers, you confirm you have authority to accept these Terms on their behalf.
The person making the reservation is financially responsible for the booking in full.
2. Reservations and Confirmation
All reservations are subject to availability. A booking is confirmed only once you receive written confirmation including a booking reference number.
The Client must provide accurate and complete information, including: flight number, arrival or departure time, passenger count, pickup and drop-off details, and a valid contact number (WhatsApp recommended).
HolaBayahibe is not responsible for service disruptions caused by incorrect or incomplete information provided by the Client.
All passengers in a private airport transfer must arrive on the same flight unless otherwise agreed in writing. Standby flight reservations are not accepted.
For private residences or Airbnb pickups, the full address must be provided at least 24 hours before service. Failure to do so may result in cancellation without refund.
Last-minute bookings may incur additional charges and are subject to operational availability.
3. Prices and Payment
All prices are quoted in United States Dollars (USD). Full payment is required at the time of booking unless otherwise agreed in writing.
Payments are processed through secure third-party providers. HolaBayahibe does not store credit card information.
Exchange rates and foreign transaction fees are determined solely by the Client's payment provider. Refund amounts may differ due to exchange rate fluctuations.
Night or early morning services (11:00 PM – 6:00 AM) may carry additional charges where indicated at booking.
Clients agree to contact HolaBayahibe directly before initiating any payment dispute or chargeback. Fraudulent or unjustified chargebacks may be formally contested.
4. Cancellation and No-Show Policy
Cancellations made at least 24 hours before scheduled pickup are eligible for a full refund.
Cancellations made less than 24 hours before scheduled pickup are non-refundable.
A "No-Show" occurs when the driver arrives at the designated location, the Client fails to appear within the waiting period, and no communication is received before the waiting period expires. No-shows are non-refundable.
If the driver is en route or has arrived and the Client cancels at the last minute, no refund will be issued.
5. Pickup and Schedule Changes
Changes requested more than 24 hours before pickup are subject to availability and generally accommodated without additional fees.
Changes requested within 24 hours of service are not guaranteed and may incur additional charges. Changes requested within 6 hours of service may be treated as cancellations.
If the driver arrives at the scheduled pickup time and the Client requests a delay without prior notice, the driver will wait up to 15 minutes. After this period, the service may be considered a no-show.
HolaBayahibe is not responsible for missed flights resulting from Client-requested schedule changes.
6. Airport Arrivals and Departures
We make reasonable efforts to monitor flight schedules.
For airport arrivals, drivers will wait up to 90 minutes after actual landing time unless otherwise specified in confirmation.
For departures, passengers must be ready at the scheduled time. A 15-minute courtesy wait applies.
If the driver is not immediately visible, the Client must contact the number provided in the confirmation message.
7. Vehicles and Capacity
Vehicles are air-conditioned and professionally maintained.
The Company reserves the right to substitute vehicles of equal or higher category for operational reasons.
Passenger and luggage limits must not exceed vehicle capacity. Service may be refused without refund if safety limits are exceeded.
8. Luggage Policy
Standard allowance: one suitcase and one carry-on per passenger unless otherwise declared.
Oversized items must be declared at booking.
Clients are responsible for their luggage at all times. HolaBayahibe is not responsible for forgotten items. Return of located items may incur additional fees.
9. Child Safety Seat Policy
HolaBayahibe does NOT provide child seats for rent.
Clients traveling with infants or children requiring safety restraints must bring and install their own approved child seat.
Parents or guardians are solely responsible for selecting and properly installing appropriate child restraints. Drivers may refuse service if safe seating arrangements are not provided.
By booking, the Client acknowledges full responsibility for child passenger safety.
10. Alcohol and Drug Policy
The Company may refuse service to any person appearing intoxicated or under the influence of illegal substances.
Possession or use of illegal drugs inside the vehicle is strictly prohibited. Alcohol consumption inside the vehicle is not permitted unless expressly authorized in writing.
Unsafe, aggressive, or unlawful behavior may result in immediate termination of service without refund. Authorities may be notified if required by law.
11. Mechanical Issues and Subcontracting
In case of mechanical issues, the Company may dispatch a replacement vehicle or arrange alternative transportation.
Minor mechanical issues resolved promptly do not qualify for reimbursement.
During peak periods, services may be fulfilled by affiliated or third-party providers. Vehicles and drivers may not display HolaBayahibe branding.
12. Intermediary Status and Service Disclaimer
HolaBayahibe may act as an intermediary between Clients and independent transportation providers ("Service Providers"). Service Providers are independent contractors and not employees of HolaBayahibe unless expressly stated.
HolaBayahibe does not directly control independent Service Providers and is not responsible for their acts, omissions, negligence, or misconduct.
Services are provided on an "as available" basis. We do not guarantee uninterrupted or delay-free service. Website images and descriptions are illustrative and may not reflect the exact vehicle used.
13. Denial of Service
Service may be refused without refund in cases of: safety risks, violation of alcohol/drug policies, aggressive or offensive conduct, or exceeding declared passenger or luggage limits.
Driver safety decisions are final.
14. Limitation of Liability
HolaBayahibe shall not be liable for delays or service interruptions caused by circumstances beyond reasonable control, including traffic, weather, government actions, or civil unrest.
Except in cases of gross negligence or willful misconduct, total liability shall not exceed the amount paid for the specific booking.
HolaBayahibe is not liable for indirect or consequential damages, including missed flights or loss of enjoyment.
15. Force Majeure
If services cannot be performed due to force majeure events, HolaBayahibe may reschedule or issue service credit at its discretion.
16. Complaints and Claims
Written complaints must be submitted within 14 days of service completion. Claims submitted after this period may not be considered.
17. Privacy
Personal information is used solely to provide and improve services and is not sold to third parties except as necessary to fulfill the booking.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Dominican Republic.
Any dispute shall be resolved exclusively in the courts of the Dominican Republic, unless mandatory consumer protection laws require otherwise.
